Please read the booking rules below carefully. Each reservation, after its confirmation, has the value of a contract according to current Italian legislation. The contract is binding for the person making the reservation and for all other subjects mentioned in it. Applies to all bookings made directly with Casa Martilenkos

Everything below explains these points in full. If anything is unclear, write to us before you book — we would much rather answer a question than resolve a misunderstanding.

1. Who you are booking with

‍ ‍

Casa Martilenkos is a boutique property in Monzambano (MN), Lombardia, comprising two self-contained suites — the Moroccan Suite and the Lumi Suite.

These conditions govern short-term tourist accommodation contracts concluded directly with us. Bookings made through Airbnb, Booking.com or another platform are governed by that platform's own payment and cancellation terms.

2. How a booking is made

‍ ‍

  1. Enquiry. You send an availability request through our website or by email.

  2. Offer. We reply with a written offer setting out the dates, the suite, the total price and the payment terms. This offer is not yet a contract, and the dates are not held for you until it is accepted.

  3. Acceptance and deposit. You confirm in writing and pay the 30% deposit within 48 hours, using the secure payment link we send you or by bank transfer. If the deposit is not received in that time, the offer lapses automatically and the dates are released, unless we have agreed otherwise in writing.

  4. Confirmation. Once the deposit is credited to us, we send you a final confirmation email together with our House Rules and the written accommodation agreement. The contract is formed at that moment, and is binding on the person booking and on all guests named in the booking.

Please check your confirmation carefully. If any detail is wrong — names, dates, suite, price, number of guests — tell us within 4 days so we can correct it. Reporting later does not invalidate your booking, but a correction may no longer be possible.

3. Payment

‍ ‍

  • Deposit: 30% of the total price, within 48 hours of our offer.

  • Balance: the remaining 70%, payable on arrival, or earlier by bank transfer if you prefer.

  • Accepted methods:bank transfer and card payment via our secure payment link (Stripe). We do not keep your card details on file and we never charge a card automatically.

  • Prices are in euro. Bank charges on transfers are the sender's responsibility: the amount we receive must equal the amount invoiced.

  • Tourist tax (imposta di soggiorno), where the Comune di Monzambano applies it, is set by the municipality, is not part of our rates, and is collected separately on site. Current amount: [€X per person per night, up to X nights · exemptions: children under X].

4. Cancellation, changes and non-arrival

‍ ‍

We are a two-suite property. When a booking is cancelled, the dates rarely sell again — which is why our conditions are clear and firm.

4.1 If you cancel

  • Bookings made 30 days or fewer before arrival: the deposit is non-refundable from the moment the booking is confirmed.

  • All cancellations must be in writing to casamartilenkos@gmail.com. The date we receive your email is the date that counts.

  • The deposit is a confirmatory deposit (caparra confirmatoria, Art. 1385 of the Italian Civil Code). No amount retained under this section ever exceeds the total price of your booking.

4.2 If you want to change your booking

‍ ‍

We will always try to accommodate a change of dates, suite or guest numbers, but we cannot guarantee it.

‍ ‍

  • A change requested 31 days or more before arrival is free of charge, subject to availability. If the new dates cost more, the difference is payable; if they cost less, the difference is not refunded.

  • A change requested 30 days or fewer before arrival is treated as a cancellation followed by a new booking, and the terms in §4.1 apply.

4.3 Insurance

‍ ‍

Because our conditions are firm, we strongly recommend travel cancellation insurance. Most policies cover illness, family emergencies and transport failure — situations in which we are unfortunately not able to make exceptions.

4.4 If we have to cancel

‍ ‍

If we cancel your confirmed booking for any reason within our control, you receive a full refund of everything you have paid, plus an equal amount again as compensation, within 14 days. We will also help you find comparable accommodation in the area.

If we cannot host you because of an event genuinely outside our control — a legally imposed closure, a natural event, or damage that makes the suite unusable and unsafe — you receive a full refund of everything you have paid, within 14 days, and we will help you find comparable accommodation in the area. In that case no further compensation is due, on either side.

‍ ‍

5. Arrival, identity documents and check-out

‍ ‍

  • Check-in: 15:00–20:00. Check-out: by 11:00. Other times by prior arrangement, subject to availability.

  • We welcome every guest in person. There is no keybox and no unattended self check-in — this is a legal requirement in Italy, and it is also how we prefer to meet you.

  • A valid identity document is required for every guest, including minors, and must be presented at check-in. We are obliged to register all guests with the Italian State Police within 24 hours (Art. 109 TULPS). We cannot accommodate anyone who does not provide a document.

  • Please let us know your estimated arrival time the day before, and message us when you reach the main gate.

6. Guests, occupancy and use of the property

‍ ‍

  • Only the guests named in the confirmation may stay. Maximum occupancy is 2 guests per suite and cannot be exceeded, for insurance and safety reasons.

  • Visitors are welcome during the day with our prior agreement; they may not stay overnight.

  • Pets are not accepted.

  • Smoking is not permitted indoors.

  • No parties, events or commercial photography without our written consent.

  • The suites are part of a working olive farm and a family home. Our House Rules — quiet hours, waste separation, use of the garden and grounds — are provided with your confirmation and on arrival, and form part of this contract, together with the written accommodation agreement.

  • The person making the booking is responsible for the conduct of all guests and for any damage they cause. We do not take a security deposit and we do not pre-authorise cards; we simply ask that you tell us straight away if something breaks. Damage or missing items beyond normal wear and tear, and any deep cleaning made necessary by smoking indoors, will be invoiced at cost with supporting documentation.

7. Our responsibility, and its limits

‍ ‍

We look after this property carefully and we want your stay to be perfect. Realistically:

‍ ‍

  • We are fully responsible for the safety of the property and for our own acts. Nothing in these conditions limits our liability for death, personal injury, gross negligence or wilful misconduct.

  • We are not responsible for temporary interruptions to electricity, water, internet or heating caused by external suppliers or by faults outside our control — though we will do everything we reasonably can to restore them quickly, and will compensate you fairly if a serious failure lasting more than 24 hours is genuinely our fault.

  • We are not responsible for weather, natural events, road closures, public-health measures, or the acts of third parties, nor for valuables left unattended.

  • Seasonal realities of a rural property — insects, agricultural work in neighbouring fields, church bells, farm machinery, occasional noise from the olive grove — are part of the place and are not grounds for a refund.

  • Use of the garden, grounds and olive grove is at your own risk. Children must be supervised by an accompanying adult at all times.

8. If something goes wrong during your stay

‍ ‍

Tell us immediately — we live a few metres away and almost everything can be fixed on the spot. Complaints raised only after departure are much harder for us to put right, and we may not be able to offer a remedy for something we were never given the chance to resolve.

‍ ‍

If we cannot reach an agreement, you may refer the matter to a certified Italian consumer ADR body (organismo di mediazione / conciliazione paritetica) before going to court. We will take part in good faith. Note that the European Commission's online dispute-resolution (ODR) platform ceased operating in July 2025.

9. Cooling-off period

‍ ‍

Under Art. 59 of the Italian Consumer Code (D.Lgs. 206/2005), implementing Directive 2011/83/EU, the 14-day right of withdrawal for distance contracts does not apply to accommodation booked for a specific date or period. Your booking is binding from confirmation, and the cancellation terms in §4 apply instead.

10. Your data

‍ ‍

We process your personal data — and that of your fellow guests — to manage your booking, to meet our legal obligations on guest registration and tax, and, only if you opt in, to send you occasional news about the house. Full details are in our Privacy Notice at [www.martilenkos.com/privacy], provided under Art. 13 GDPR. You may ask us at any time to access, correct or delete your data.

11. Governing law, jurisdiction and language

‍ ‍

  • These conditions are governed by Italian law, with the mandatory consumer-protection rules of your country of residence unaffected.

  • If you are a consumer, any dispute may be brought before the court of your place of residence or domicile, or before the court of Mantova, at your choice.

  • Should any individual clause be held invalid or unenforceable, the rest remains in force.

  • These conditions are published in English and Italian. In the event of a discrepancy, the Italian version prevails; the English version is provided for convenience.
